Terms of Service
These Terms of Service (“Terms”) govern access to and use of https://fromtheclip.com and the FromTheClip service (the “Service”) operated by FiveToClose (“we,” “us,” or “our”). FromTheClip is a product of FiveToClose.
By accessing the site, signing in with Google, requesting a login code, uploading a file, playing a story, or buying credits, you agree to these Terms, our Privacy Policy, and Disclaimer. If you do not agree, do not use the Service.
1. Description of the Service
FromTheClip is a playable story product. You upload an MP4 (hero path) or a still. After you sign in (Google, or an email code) we generate a short next scene that keeps the same people, then you pick a door: what happened before, or what happens after. Stories stay on that login. Only the path you choose is generated and charged.
The Service is entertainment software. It is not a video editor, not a stock-footage house, not a likeness marketplace, and not a documentary studio.
The Service is provided “as is” and “as available.” Features, models, durations, and pipelines may change. Generated video is typically about six seconds per scene. Results vary. Faces, clothes, and places may drift. That is the medium.
2. Eligibility
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. You may not use the Service if you are barred under applicable law or if we have previously suspended your account.
3. Accounts and email verification
- Access requires an email address and a one-time code. Generation does not run until that email is confirmed.
- You must provide an email you control. You are responsible for activity under that email, including anyone who can read the code.
- We keep you signed in with a session cookie named
ftc. - Notify support@fivetoclose.cloud immediately of unauthorized use.
- We may suspend or terminate accounts for security risk, fraud, abuse, unpaid chargebacks, or Terms violations.
4. Credits, packs, and billing
The internal unit is one scene — one generated video. Credits never expire while the Service operates. There is no subscription and no unlimited plan.
- Free (email verified): USD $0 — 1 scene (first look after the clip)
- After: USD $2.99 — 3 scenes
- Cut: USD $9 — 10 scenes. Coupon code AFTER applies a one-time discount (currently 70% off) on the Cut pack for a first purchase, when the code is valid and we honor it at checkout
- Reel: USD $24 — 30 scenes
- Vault: USD $47 — 80 scenes
Prices are in United States dollars and may exclude applicable taxes. Packs are one-time purchases, not a store of cash you can withdraw. Credits are added to the signed-in email after Stripe confirms payment.
Reserve / charge / restore. When you choose a path we may reserve one credit, charge it when generation succeeds, and restore it if generation fails. Opening a door with zero credits does not generate a scene; it takes you to checkout. The $2.99 After pack is offered first.
Billing is handled by Stripe. Except where required by law or where we expressly agree in writing, pack fees are non-refundable once paid, including if you dislike a scene, a face drifted, or you stop playing. A failed generation restores the scene credit, not necessarily a card refund.
Coupon codes may be modified or revoked. First-purchase limits and anti-abuse checks apply. Failed payments do not add credits.
5. Uploads, license, and your rights
You keep the rights you already have in files you upload and in premises you write. You grant FiveToClose a limited, non-exclusive license to store, transcode, extract frames from, analyze, and generate derivative scenes from that material only to run your story on the Service. We do not use your uploads to train FiveToClose models. We do not reuse your uploads as opening material for other users.
By uploading you represent and warrant that:
- You own the file or have a license / permission sufficient to upload it and to authorize the generation described here
- The file is SFW and depicts original or licensed fictional characters, or people you have lawful rights to depict in this way
- The file is not a celebrity likeness you do not control, not an identity clone, and not a non-consensual deepfake
- The file does not infringe copyright, trademark, publicity, or privacy rights of a third party
- Maximum size: 80MB video, 8MB image; MP4 or common still formats
We may refuse, mute, delete, or halt a story that appears to break these rules. You remain solely responsible for the upload and for how you use the output.
6. Prohibited use
You agree you will not:
- Upload or request sexual content, pornography, or content involving minors (anyone 17 or under) — zero tolerance
- Upload celebrities, politicians, or other public figures to clone their face
- Create non-consensual intimate imagery or real-person deepfakes you do not have rights to
- Attempt to impersonate a real private person for fraud, harassment, or defamation
- Reverse engineer, overload, scrape, or disrupt the Service
- Resell access, share login codes as a public dump, or treat credits as a cash instrument
- Use the Service for any unlawful purpose
We may report illegal content to authorities where required.
7. Generation, labeling, and no results promise
Generated scenes are AI-generated entertainment and are labeled as such on the Service. They are fiction. They are not a record of what a real person did before or after a clip. Character lock is a best-effort pipeline (opening frame, last frame, written lock sheet). Drift happens. That is not a defect you can charge back.
We do not warrant that a scene will print, that a face will match, that a choice prompt will make sense, or that the Service will be uninterrupted. If generation fails, we restore the scene credit. That is the remedy unless law requires more.
You may pause at any time. Unused credits remain on the account. Closing the tab does not cancel reserved work already sent to a provider.
8. Intellectual property in the Service
The Service, branding, software, UI, and documentation are owned by FiveToClose or our licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Service for your personal entertainment.
As between you and us, and subject to third-party model-provider terms, we assign to you whatever rights we can in the specific generated scene produced for your account, for personal entertainment use, except that we retain the right to store it to operate the Service, to enforce these Terms, and to comply with law. You may not claim the output is a photograph of a real event or a licensed celebrity endorsement.
9. Third-party services
The Service depends on third parties including Stripe, AI providers (including xAI), hosting, storage, and email delivery. We do not control their availability, policies, or pricing. Your use of those services is also subject to their terms.
10. Suspension and termination
We may suspend or terminate access immediately if we reasonably believe you violated these Terms, pose a security or abuse risk, initiated a chargeback without basis, or if required by law. You may stop using the Service at any time. Provisions that by nature should survive (including disclaimers, liability limits, indemnity, and payment obligations incurred) survive termination. Unused credits are not a cash refund at termination except where required by law.
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SCENES WILL MATCH A PERSON, THAT GENERATION WILL SUCCEED, OR THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIVETOCLOSE, FROMTHECLIP, AND THEIR OPERATORS, AFFILIATES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR CREDITS IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM (OR USD $50 IF YOU HAVE NOT PAID US).
13. Indemnity
You agree to indemnify, defend, and hold harmless FiveToClose, FromTheClip, and their officers, agents, and contractors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to: your use of the Service; your uploads and premises; alleged publicity, privacy, or copyright claims in your files; your generated scenes as you use or publish them; your violation of law or third-party rights; or your breach of these Terms.
14. Changes to the Service or Terms
We may modify the Service or these Terms. We will update the “Last updated” date when Terms change. Material changes may be communicated via the site or email when practical. Continued use after changes constitutes acceptance.
15. Governing law
These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict-of-law rules, unless mandatory consumer protections in your jurisdiction require otherwise. Venue for disputes shall be in courts located in Texas, USA, except where prohibited.
16. Miscellaneous
If any provision is unenforceable, the remainder stays in effect. These Terms, the Privacy Policy, and the Disclaimer are the entire agreement regarding the Service. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
